Grievance/arbitration hearings in two NACST affiliates resulted in the re-hiring of teachers
fired in the 2004-2005 school year.
In both instances arbitrators penalized the teachers with suspensions without pay rather than
dismissal.
In Philadelphia, ACT successfully argued that the firing of a teacher for "serious neglect of
duty" was done without just cause and in violation of contractual provisions for discharge.
In the Camden diocese, CTU successfully argued that the dismissal of a teacher under the
Bishop's Clause was too extreme, and that progressive discipline measures should have been taken.
