Current Contract - Article 8 - Tenure

SECTION A
Tenure is defined solely as the right to an automatic renewal of contract.

SECTION B
Tenure shall be granted by the Director of Education and shall be: honored in all Diocesan High Schools.

SECTION C
A newly employed teacher shall be considered probationary for the first ninety (90) days of employment.  The employer shall have the right to remove from its employ any probationary employee at any time during the probationary period. Neither the: probationary employee nor the Association shall have any recourse to such removal action.

SECTION D
In order to attain tenure, teachers in the bargaining unit must attain Diocesan accreditation and complete six (6) semesters of satisfactory teaching at their current school.

SECTION E
Non-probationary teachers who have not received tenure shall have their contracts renewed unless the teacher fai1s to obtain Diocesan accreditation within the time limits prescribed, or receives two (2) unsatisfactory formal classroom evaluations and one (1) unsatisfactory summative evaluation within a school year, or said teacher's position is eliminated.

SECTION F
After tenure is granted, tenured teachers' contracts must be renewed unless the teacher fails to obtain Diocesan accreditation within the time limits prescribed, or receives tbree unsatisfactory formal classroom evaluations and one (1) unsatisfactory summative evaluation within a school year, or said teacher's position is eliminated.

SECTION G
Any teacher may be discharged at any time for just cause, subject to the provisions of the Agreement.

SECTION H
Attendance at continuing education courses is optional. Tenured and non-tenured teachers who choose to take continuing education courses may seek reimbursement according to the following guidelines:

1. Teachers must seek approval from the principal of the high school in advance of registering for the course.
2. The principal will give approval based on these priorities:
a. Teachers with PA Instructional I Professional Certiflcation must take courses leading to PA Instructional II Professional Certification.
b. Teachers working for a master's degree must take courses that are within their teaching competency or that lead to another teaching competency.
c. Teachers who wish to update themselves professionally must take courses that are within their teaching competency or that lead to another teaching competency.
3. The Diocese will pay full tuition for up to four (4) credits or units during the lifetime of this contract. Payment shall be made within thirty (30) days of notice of successful completion of the work with a grade of B or better.
SECTION I
No tenured teacher shall be displaced from employment by clergy or religious.
